
DBDomain's Oracle Training Subscriber License
Subscriber agrees that Database Domain subscription will be used only by the registered subscriber, and not by any other person without express, written authorization by 4SKWare Technologies, Inc./The Database Domain. The Database Domain reserves the right to log and analyze access to The Database Domain to enforce this policy. Any violation of this policy is grounds for immediate termination of subscription with no refund monies issued.
You are responsible for maintaining the confidentiality of the password you are given to access The Database Domain, and are fully responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for all activities that occur under your password and account. You need to notify The Database Domain immediately of any unauthorized use of your password, and you need to exit/logoff your web browser immediately after you use the Service. The Database Domain cannot and will not be responsible for any loss or damage arising from your failure to comply with these requirements.
No security breaches or attempts at circumventing access to authorized areas (e.g., probes for password files, unauthorized file downloads, etc.) will be tolerated by The Database Domain. These breaches or attempted breaches are grounds for immediate termination of subscription with no refund monies issued.
The Database Domain does not allow its subscribers to use offline web browsers, viewers, or rippers, etc. to download Web site contents for off-line viewing. All content in secure, subscribers-only directories is intended for online viewing only. Any violation of this policy is grounds for immediate termination of subscription with no refund monies issued.
Attention North Carolina Residents: Subscriber or subscriber's employer shall be responsible for all taxes related to The Database Domain subscription fee, if any, except any taxes on the net income of 4SKWare Technologies, Inc.
The content available at The Database Domain, which is copyrighted, is the sole and exclusive property of 4SKWare Technologies, Inc. Subscriber agrees not to sell, transfer, publish, disclose, display or otherwise make it available to others.
The Database Domain does not warrant that the content at The Database Domain will meet Subscriber's requirements or that its use will be uninterrupted or error free. The Database Domain is licensed "as is" and 4SKWare Technologies, Inc. makes no warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the quality and performance of The Database Domain is with the Subscriber.
4SKWare Technologies, Inc. shall have no liability with respect to its obligations under this license or otherwise for direct, special, incidental, consequential, or exemplary damages even if it has been advised of the possibility of such damages. In no event shall licensor's liability for any reason whatsoever exceed $0.
The Subscriber's subscription (license) to The Database Domain may be terminated immediately by The Database Domain if The Database Domain determines breaches to any of the terms in this agreement, or upon termination of Subscriber's business. No refund monies will be issued.
NO DATABASE DOMAIN OR 4SKWARE TECHNOLOGIES INC. LIABILITY
In no event shall The Database Domain or 4SKWare Technologies be liable to anyone for any delays, inaccuracies, errors or omissions with respect to the Information or the transmission or delivery of all or any part thereof, for any damage arising therefrom or occasioned thereby, or for the results obtained from the use of the Information. The Database Domain or 4SKWare Technologies will not be responsible if any Information infects or contaminates a User's system or information. The entire risk as to the quality and performance of The Database Domain and the accuracy, adequacy, completeness, currentness, validity, and quality of any Information is with the User.
USER'S DUTY
User shall 1) Determine whether the Information complies with User's needs; 2) Determine whether User has adequate legal rights to store, reproduce, or otherwise make use of Information in the manner contemplated by User; 3) Comply with any legal obligations, including but not limited to, obligations imposed by copyright, secrecy, defamation, decency, and export laws; and 4) Isolate Information, execute anti-contamination software and otherwise take steps to ensure that Information, if contaminated or infected, will not damage User's information or system.
